These Terms of Service (“Terms”) govern your use of pharmaceuticaltw3.com (the “Site”) and purchases made through it. The Site is operated by PHARMACEUTICAL TW3 LLC, a New Mexico limited liability company located at 1008 20th St NW, Albuquerque, NM 87104 (“we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old and located in the United States to purchase from the Site.
2. Products and health information
TW3 herbal formulas sold on the Site are dietary supplements; they are not drugs and are not intended to diagnose, treat, cure, or prevent any disease. Golden Star Balm is an aromatic balm for external use only and must be used as directed on its label. Statements on the Site have not been evaluated by the Food and Drug Administration. Information on the Site is for general educational purposes only and is not medical advice. Always read the product label and consult a qualified healthcare professional before use, especially if you are pregnant or breastfeeding, take medication, or have a medical condition. Products are manufactured by Central Pharmaceutical Joint Stock Company No. 3, Hai Phong, Vietnam, and imported and distributed in the United States by PHARMACEUTICAL TW3 LLC.
3. Product information and pricing
We try to display product information, images and prices accurately. Packaging may change and may differ slightly from images; always follow the label on the product you receive. All prices are in U.S. dollars. We may correct errors and change prices or availability at any time. If a product is listed at an incorrect price, we may cancel orders placed at that price and refund you in full.
4. Orders and payment
Your order is an offer to buy. We may accept or decline an order, limit quantities, or cancel an order, including for suspected fraud, unavailable stock or pricing errors. Payment is processed by our third-party payment providers at checkout as described in our Payment Policy. Sales tax is added where required.
5. Shipping, returns and refunds
Shipping is described in our Shipping Policy. Returns and refunds are described in our Returns & Refunds Policy. Both are part of these Terms. Title and risk of loss pass to you when the order is delivered to the carrier.
6. Responsible use
You agree to use products only as directed on the label, not to exceed the recommended intake, and to keep products out of reach of children. Products are for personal use and may not be resold without our written permission.
7. Accounts
If you create an account, you are responsible for keeping your login details confidential and for activity under your account. Notify us promptly of any unauthorized use.
8. Prohibited uses
You may not use the Site to break the law, submit false information, interfere with the Site’s security or operation, scrape or copy content in bulk, or place orders for resale or export without our permission.
9. Reviews and communications
If you submit a review or other content, it must be truthful and based on your own experience, must not include health claims about diagnosing, treating, curing or preventing disease, and must not be unlawful or offensive. You grant us a non-exclusive, royalty-free license to display content you submit. We may remove content at our discretion. By placing an order you agree to receive transactional emails about it; marketing emails are sent only with your consent.
10. Intellectual property
The Site content, including text, graphics, logos and images, belongs to us, the manufacturer or our licensors and may not be copied or used without permission. “TW3” and “Golden Star” names and marks belong to their respective owners.
11. Third-party services and links
The Site may link to or use third-party services such as payment processors and carriers. We are not responsible for third-party websites or services, which are governed by their own terms.
12. Disclaimer of warranties
Except as expressly stated in these Terms or required by law, the Site and products are provided “as is” and “as available,” and we disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law. Individual results vary.
13. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim related to the Site or a product is limited to the amount you paid for that product. We are not liable for indirect, incidental, special or consequential damages. Some states do not allow these limitations, so they may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless PHARMACEUTICAL TW3 LLC from claims arising out of your misuse of the Site or products or your violation of these Terms, to the extent permitted by law.
15. Dispute resolution and governing law
Before filing a claim, please contact us at [email protected] and give us 30 days to try to resolve the issue informally. These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-law rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in Bernalillo County, New Mexico, or in small claims court where you live, unless applicable law requires otherwise.
16. Changes, severability and entire agreement
We may update these Terms from time to time; changes apply to orders placed after the updated Terms are posted. If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with the policies linked above, are the entire agreement between you and us regarding the Site.
